The reforms will allow the issue of a traffic infringement notice, or a TIN, to novice car learners (L1 and L2) who drive without an appropriate supervising driver. The TIN penalty will be a $150 fine and a three-month period of disqualification.
The learner licence will be cancelled for a minimum of 3 months in addition to any other period of disqualification imposed by the Courts.
Note: A defence exists in the legislation to allow a Court to impose a lesser penalty and/or fine if it considers it is just to do so. This would cover, for example, where a learner was not, or could not have been, aware that their supervisory driver was not appropriately qualified.
