However, if the private siding is to be connected with, or to have access to, a railway or siding of an accredited person, the private siding must be registered and pay an annual fee. * A private siding is defined by the Rail Safety Act 2009 as: "private siding means a siding that is managed, owned or controlled by a person, other than a person who manages the infrastructure with which the siding connects or to which it has access, but does not include: (a) a marshalling yard; or The Rail Safety Regulations 2010 prescribe the following to not be a private siding: (a) a siding under the control and management of an accredited rail infrastructure manager; (b) a balloon loop used for loading or unloading trains.
