22. What is P1 restart?

P1 restart means that the person who is convicted of any of the following offences will be required to begin the 12-month P1 provisional period again - or 'restart':

  • Speeding by 10km/h or more above the legal limit
  • Use of a mobile phone while driving
  • Failure to wear a seat belt
  • Driving with alcohol in body
  • Failing to comply with LAMS condition (rider only)
  • Failure to display P plates (effective from 27/04/2009)
  • Failure to wear a helmet (rider only) (effective 27/04/2009)

23. What happens if I have progressed to the P2 stage when I am convicted of a P1 offence?

If you have progressed to the P2 stage when convicted of any P1 restart offence, the P2 stage will be extended for the amount of time the P1 licence would have been restarted.

24. What happens if I have progressed to Full when I am convicted of a P1 offence?

If you have progressed to a full licence when you are convicted of a P1 restart offence, the offence is recorded but no further action is taken.

25. What happens if I hold a full car licence and a P1 motorcycle licence?

If I hold a full car licence and a P1 motorcycle licence and am convicted of a restart offence (see question 22 for restart offences) in the car, my P1 motorcycle licence is restarted.

The same applies in reverse; if I hold a full motorcycle licence and a P1 car licence and am convicted of a restart offence while operating the motorcycle, my P1 car licence will be restarted.

26. Why does my Rider P1 restart when I committed an offence on my full car licence?

This is because committing traffic offences is attributed to driver behavior not the vehicle you were driving at the time when the offence was committed.

27. If I receive a demerit point offence that is used towards restarting my P1 licence, can the same demerit point count towards a disqualification or suspension?

Yes.  Regardless if you incur a P1 restart from a demerit point offence this same demerit point can count towards a disqualification or suspension.   This is because a Restart offence is not caused by the points you receive from the offence, but by the traffic offence itself.
